UPDATE: Carlson broke his silence Thursday for the first time since being fired by Fox News with a tweet saying “See you soon,” The Hill reports. In a two-minute-plus message, he said that after “stepping outside the noise for a few days” he is gratified by how many “genuinely nice people there are in this country.”

Tucker Carlson Tonight's eponymous host has left the building. Fox News Monday in a statement said that Carlson and the network have mutually agreed to part ways. Carlson's ultimate Tonight broadcast was last Friday night, though the host leaves behind a sort of director's cut of the January 6 Capitol insurrection video recordings after House Speaker Kevin McCarthy (R-CA) handed him previously unseen footage, as well as fawning interviews with Hungary’s authoritarian prime minister, Viktor Orbån.

The network will air an interim program creatively titled, Fox News Tonight at 8 p.m. Eastern Time weekdays, with interim personalities until a replacement host is named.

Carlson’s departure comes less than a week after Fox News’ $787.5-million settlement with Dominion Voting Systems. Evidence for Dominion’s lawsuit included emails by Carlson saying he was “fed up” with Donald J. Trump after losing re-election in 2020.

“I hate him passionately,” one of Carlson’s emails said.

Russian, Chinese and Iranian Tweets (Oh My) --

Twitter has lifted “shadow bans” on the government accounts of Russia, China and Iran, NPR reported last week. All Things Considered confirmed Twitter’s “stance of allowing the Russian government posts to pop up freely” on users’ feeds “and has now become company procedure.”

NPR reported the policy change days after the public radio outlet, along with the BBC and others left Twitter after owner/CEO Elon Musk falsely accused these media outlets of being “government funded.”

Musk defended anti-Ukrainian rhetoric posted by former Russian President Dmitry Medvedev on Twitter, responding; “All news is to some degree propaganda. Let people decide for themselves.”

Irony alert: Twitter is not allowed in Russia, China and Iran, according to the NPR report.

Florida Man Fading?

A week of punditry suggesting undeclared 2024 presidential candidate Ron DeSantis has peaked in his effort to topple Donald J. Trump has culminated in a Wall Street Journal poll Friday showing the former president leading the Florida governor in a two-man race, 51% to 38%. That’s a swing from a 14-point lead for DeSantis in a WSJ poll taken last December, the newspaper says.

The Wall Street Journal also polled for a potential field of 12 Republican contenders, which adjusted Trump’s lead to 48% versus 24% for DeSantis. Former UN Ambassador Nikki Haley was third in this poll, at 5%.

Conservative and liberal pundits seem to agree that DeSantis isn’t a very good candidate, even before declaring. Traditional Republicans question whether DeSantis is even a true conservative considering his “culture war” vs. free enterprise stance in a very public fight with one of his state’s biggest employers, Disney.

Semafor reports Friday that Trump has been dominating DeSantis in the race for endorsements from Florida’s congressional delegation. Neither has the support, yet, of Sen. Marco Rubio, who told the news outlet he isn’t ready to take sides, but “recently hung out with Donald J. Trump at a UFC event” and “hasn’t heard from DeSantis for a ‘number of months.’”

Not a University of Florida branch: Yeah, sigh, we had to look it up. “UFC” stands for Ultimate Fighting Championship.

Manchin for Prez in ’24, as a Republican?

Sen. Joe Manchin (D-WV) (above) would not say whether he will run for re-election in 2026, nor would he rule out running for president as a Republican, in his Sunday appearance with Chuck Todd on NBC News’ Meet the Press. His non-answers are as good as a “maybe” to the Capitol Hill punditocracy, which began to speculate that he would switch parties and run against ex-President Trump (and probably Florida Gov. Ron DeSantis) for the 2024 GOP nomination for president.

“I haven’t made a decision on what I’m going to do in 2024,” he said, though he did rule out a run for governor of West Virginia. He’s been there already, Manchin reminded Todd. Manchin did say he would try to do “best what I can do for my country … and my state.”

Next up as a guest on Meet the Press was Rep. Nancy Mace (R-SC), the moderate who describes herself as “pro-life” yet believes her party is self-inflicting wounds with its hardline anti-abortion position. Mace said Republicans and Democrats in the House and Senate must get over their wide gaps on all sort of issues in order to move legislation forward, and used the forum to compliment the West Virginia Democrat’s centrism.

“I sometimes joke [Manchin] is the most popular Republican in the Senate,” Mace told Todd.

Four Criminal Referrals for Trump

The House Select Committee to Investigate the January 6^th Attack on the United States Capitol has issued to the Justice Department four referrals for criminal charges against former President Donald J. Trump over attempts to overturn the 2020 election. The charges did not include seditious conspiracy, the charges for which two Oath Keepers, including founder Stewart Rhodes III, were found guilty last month for their involvement in the attack.

The charges are: I.) Obstruction of an official proceeding; II.) Conspiracy to Defraud the United States; III.) Conspiracy to Make a False Statement; and IV.) “Incite,” “Assist,” “Aid or Comfort” an insurrection.

The fourth referral, if prosecuted by the Justice Department, would prevent Trump from running for any federal or state office.

“He is unfit for any office,” committee Vice Chairwoman Liz Cheney (R-WY) said.

John Eastman, the attorney who allegedly advised Trump that Vice President Mike Pence could reject the Electoral College results on January 6, also was named in the referrals. All referrals may be applied to “others” identified in the Justice Department’s investigation, panel member Adam Schiff (D-CA) noted in comments to reporters after the hearing.

Additionally, four Congress members will be referred to the House Ethics Committee for ignoring subpoenas to testify before the 1/6 committee, Rep. Jamie Raskin (D-MD) said. They are Reps. Kevin McCarthy (R-CA), Andy Biggs (R-AZ), Jim Jordan (R-OH) and Scott Perry (R-PA), Roll Call reports. A fifth, Rep. Mo Brooks (R-AL) is retiring and was left out of the referrals.

The House Ethics Committee currently has four Democratic and four Republican members, NPR says, and is unlikely to take actions against the four members before a new Congress convenes next month.

Rep. Zoe Lofgren (D-CA) said the panel has evidence of attempted witness tampering. An attorney for Trump told a witness to say under testimony that she didn’t “retain facts” and in exchange would be offered a job that “would make her very comfortable.”

In his post-hearing comments, Schiff said there was evidence that some witnesses may not have been completely forthright with the committee. Asked whether the panel has evidence backing star witness Cassidy Hutchinson’s second-hand testimony that Trump physically attacked a Secret Service agent who would not drive him to the Capitol as the insurrection began

Schiff said; “I found Cassidy Hutchinson’s testimony to be entirely credible and I leave it to you to assess the witness’ credibility.”

Warnock Wins Georgia; 51-49 Senate Count

Warnock Defeats Walker – With more than 95% of the vote counted late Tuesday, incumbent Democratic Georgia Sen. Raphael Warnock defeated Trumpian Republican challenger Herschel Walker, as projected by the Associated Press. Warnock had 50.5% of the vote in the midterm runoff to Walker’s 49.5%. That’s 1,710,503 votes for Warnock to 1,675,030 for Walker – a margin of 35,473.

Remaining votes to be counted are largely from Democratic-leaning Cobb and DeKalb counties surrounding Atlanta.

A Real Democratic Majority: The 118^th Congress’ Senate now consists of 51 Democrats and 49 Republicans, which means that the chamber’s president pro-tem, Vice President Kamala Harris, will not be called in to break ties on party lines, at least in the case of filibuster-proof budget bills. The plus-one Senate Democrat from last November’s midterm election – John Fetterman of Pennsylvania – means that committee membership numbers will not be split evenly, but rather Democrats will have a slight majority, making it a bit easier to move legislation through to the full Senate and to confirm President Biden’s federal judge nominees.

Trump Organization Guilty of Tax Fraud – A jury found ex-President Trump’s business guilty of all 17 counts of tax fraud and other financial crimes Tuesday (per The New York Times). Prosecutors had charged the Trump Organization of providing off-the-book benefits to executives, including Mercedes-Benzes, expensive apartments and private school tuition for their children and relatives.

Testimony of Chief Financial Officer Alan Weisselberg proved key to the case. The Trump Organization kept Weisselberg as CFO even as the case was being heard in New York’s state Supreme Court in Manhattan.

Officers Defending Capitol on 1/6 Awarded Medals – Law enforcement officers from the Capitol Police and the Metropolitan Police Department in Washington, D.C., who responded to the January 6 attack on the U.S. Capitol were awarded the Congressional Gold Medal in a ceremony held in the Capitol Rotunda Tuesday. Medals will be displayed at the U.S. Capitol Police, the Metropolitan Police Department, the Capitol and the Smithsonian Institution, Axios reports. Congress passed legislation last year, signed by President Biden, to award the medals.

House Speaker Nancy Pelosi (D-CA): “Exactly 23 months ago, our nation suffered the most staggering assault on democracy since the Civil War. January 6 was a day of horror and heartbreak. It is also a moment of extraordinary heroism.”

Handshakes Refused: Family of Capitol Police Officer Brian Sicknick, who died of a stroke after helping defend the Capitol, refused to shake the hands of House Minority Leader Kevin McCarthy (R-CA) and Senate Minority Leader Mitch McConnell (R-KY).

McCarthy Wins Speaker Nomination

House Republicans have nominated Minority Leader Kevin McCarthy (R-CA) for Speaker of the House, with 188 votes to Rep. Andy Biggs’ (R-AZ) 31 votes, per The Hill. McCarthy will need at least 218 of all 435 House members to become the next speaker.

As of late Tuesday, ahead of Donald J. Trump’s “very big announcement” at Mar-a-Lago, Republicans had clinched 217 House seats to the Democrats’ 206 for the 118^th Congress, leaving 12 contests yet to be determined.

McConnell Under Pressure: Meanwhile in the Senate, Florida Republican Rick Scott is challenging Sen. Mitch McConnell of Kentucky for the minority leadership and is one of “several conservative senators who have called on McConnell to delay” the vote, Axios reports, until after the December 6 Georgia runoff election between Sen. Raphael Warnock (D) and Trump-backed challenger Herschel Walker.

McConnell and Scott, Axios says, have been feuding for months over midterm campaign strategy. No matter what happens, the Democratic Party already has clinched control of the Senate. If Warnock wins re-election, Democrats will have 51 seats to the GOP’s 49.

Question: Axios uses the term “conservative” to describe Scott and other senators calling on McConnell to delay the vote for minority leader. What does the news outlet consider McConnell?

Trump Loses, Again

As expected, on The Day After, the U.S. Senate is still up for grabs. With Democrat John Fetterman (pictured) beating Trump-backed Dr. Mehmet Oz and picking up the Pennsylvania Senate seat made open by the retirement of never-Trumper Republican John Toomey, Republicans must win at least two of three undecided races currently held by Democrats, among Nevada, Georgia and Arizona. The Georgia race between Democratic Sen. Raphael Warnock and Trump-backed challenger Herschel Walker is likely to go to a December 6 runoff.

Donald J. Trump’s Senate victories Tuesday came in Ohio, where J.D. Vance beat U.S. Democratic Rep. Tim Ryan for the seat of another retiring moderate Republican, Rob Portman, and in Wisconsin, where incumbent Sen. Ron Johnson held off Democratic challenger Mandela Barnes.

The House of Representatives is still up for grabs too, with the GOP having gained just two of the five seats needed to flip the majority. NPR’s Domenico Montenaro told Morning Edition Wednesday that Republicans are likely to end up with a seven- to nine-seat gain. The resulting slim majority could pose a problem for Republican Speaker-in-Waiting Kevin McCarthy, who bent a knee for ex-President Trump shortly after the Senate voted to acquit him after his impeachment for inciting the January 6 Capitol insurrection.

McCarthy’s own vague plans for impeaching President Biden may be tougher than he had expected.

One surprising race that could flip a House seat to the Democrats: In Colorado’s 3^rd Congressional District, pro-Trump Republican incumbent Lauren Boebert trails Democrat Adam Frisch in her re-election bid.

What the GOP had come to expect was this: Republicans lost 41 House seats in 2018 with Trump in the White House, and Democrats lost 63 seats in 2010 under President Barack Obama.

It seems the same problem polling organizations had tracking Donald J. Trump v. Hillary Clinton in 2016 afflicted those organizations in 2022. Perhaps some of the intended voters who counted inflation and the economy as top concerns did not blame Biden for high inflation and the wobbly economy.

Clearest indication that Trump is done as head of the GOP is Florida Gov. Ron DeSantis’ trouncing of Democratic candidate Charlie Crist for re-election, by nearly 20 percentage points, a day after the ex-prez warned “DeSanctimonious” he could “hurt himself very badly” if he launches a run for the 2024 Republican presidential nomination. Florida is now a deep-red state, with DeSantis having flipped formerly blue Miami-Dade Tuesday. Republican Sen. Marco Rubio also easily won re-election Tuesday.

Trump apparently still plans to make his “big announcement” next Tuesday to run again in 2024.

We have seen the GOP ready to “move on” before, from the time he lost the 2020 presidential election to the the January 6^thCapitol insurrection and last August 8 when the FBI searched Mar-a-Lago for confidential government files. Is it for real this time? An article on FoxNews.com Wednesday contained the whole story in the headline, “Conservatives point finger at Trump after GOP’s underwhelming election results: ‘He’s never been weaker.’ Many conservatives say Tuesday’s election results show it’s ‘time to move on’ from Trump.”

After two years enduring Trump’s Big Lie, we may have taken a step back toward democracy.

Q3 GDP Up 2.6%

Gross Domestic Product Swings Positive – After two negative GDP quarters in a row for the first half of 2022, GDP was on the rise again for the third quarter, up 2.6% according to the Commerce Department’s advanced estimate. This “primarily reflected increases in exports,” (bolstered by the strength of the U.S. dollar due to high inflation) “and consumer spending that were partially offset by a decrease in housing investment,” according to the Commerce Department’s Bureau of Economic Analysis.

Second-quarter GDP was off 0.6%.

Big Early Voter Turnout -- As of October 26, georgiavoters.com has counted 1,123,329 early ballots for the November 8 midterm elections, compared with 743,772 at this same time in 2018, a 51% increase. According to The Washington Post mail-in ballots have “fallen off significantly,” per the Georgia Secretary of State’s office.

WaPo cites the Virginia Public Access Office that 411,000 voters have cast ballots early, more than the total number who voted there in 2018. But in North Carolina, the state’s 530,000 ballots cast is 60,000 fewer than this same point in 2018, while just 550,000 Texans have voted early, down from 695,000 by this time in ’18.

Elsewhere in Georgia: Ex-President Trump’s ultimate chief of staff, Mark Meadows (pictured), has been ordered by a South Carolina judge to travel to Atlanta to testify in Fulton County District Attorney Fani T. Willis’ investigation into election interference by Trump and his allies (per The New York Times). Meadows’ attorney James Bannister is said to be preparing an appeal on grounds the Fulton County grand jury behind the investigation does not have indictment authority.

Where’s the Beef? 1/6 Hearing Curtain Raiser

With the republic facing another public hearing by the Select Committee to Investigate the January 6^th Attack on the United States Capitol Wednesday, let’s take a look at the fast-breaking developments last week of Donald J. Trump versus the United States of America. Part of the committees’ remit is “to strengthen the security and resilience of the United States and American democratic institutions against violence, domestic terrorism, and domestic violent extremism.”

The U.S. Court of Appeals for the 11th Circuit in Atlanta in a stinging rebuke of Judge Aileen Cannon’s contrary decision, agreed with the Justice Department to let the FBI reclaim access and use 100 classified documents (and “papers physically attached to them”) taken from Trump’s residence in Florida while conducting a legal search. The Trump-appointed (just after the 2020 election) Cannon had ruled that DOJ was not to present “the seized materials to a grand jury and (use) the content of the documents to conduct witness interviews as part of a criminal investigation.”

Trump’s preposterous argument that he de-classified the documents, either verbally or non-verbally was not addressed by his attorneys (mindful of their own futures if they advised Trump otherwise since there are clear procedures for de-classification?) was rejected completely in the appellate court ruling that said the law should not give Trump special treatment no matter what he was or is. So damaging was the ruling apparently to Cannon’s future career that she cancelled her stay against the use of the documents on the very evening the Court of Appeals issued the reproach.

Then came the special master that the Cannon ruling specified … as part of her egregious opinion in favor of the legally imperiled Trump and his attorneys. Enter special master Raymond J. Dearie, semi-retired judge from the Federal District Court for the Eastern District of New York. He was proposed by Trump’s attorneys and DOJ agreed that he read and sort through 11,000 records or documents that left the White House and turned up in the long-delayed August 8 search of Mar-a-Lago, after more than a year of DOJ maneuvering to get the National Security documents returned.

Dearie, who clearly is tired of all the lies and false arguments floating about in Trump-land in effect said, “Where’s the beef?” Dearie issued an order after the appellate court ruling asking Trump’s lawyers to let him know if there were any discrepancies between the documents that were kept at Mar-a-Lago and those the FBI said it had hauled away. He was countering false allegations that the FBI planted documents. Where’s your evidence, Trump?

This whole sordid affair would be farce if it solely existed on a Broadway stage: Mari Lago Magic Wand Madness Review and the Art of the Steal. The absurd jokes and steady laughter start as the curtain rises. A president can declassify simply by thinking about it, Trump told Sean Hannity. Guffaw. And the FBI in its legal search was really looking for the deleted e-mails of Hillary Clinton. Guffaw, guffaw. If they are deleted how would Trump have possession of them? Guffaw, guffaw, guffaw. If Trump had them, he certainly would have used them during the last 18 months when he illegally removed presidential records from the White House. Right? Guffaw. Guffaw, guffaw, guffaw.

Enter stage left, the New York attorney general with fraud charges, looking to fine Trump $250 million and stop him from doing business ever again in the state. Another “witch hunt” claim is not enough. Trump counters by appearing at his own rallies as a QAnon true believer and booster. Wait, there’s a last-minute script change. It’s Trump and company who are the Satan-worshipping pedophiles in our midst sucking the blood of our children so they won’t live to defend our democracy.

Curtain for the Mari Lago Magic Wand Madness Review and Art of the Steal?

As grim as Trump’s legal prospects look, there’s also the prospect of conspiracy charges over the 1/6 mob’s effort to have Mike Pence hanged, and ongoing election interference charges in Georgia. Perhaps now, finally, the GOP establishment has had enough. Nonetheless, all the investigations and potential charges haven’t significantly changed people’s views of him, a New York Times/Siena College poll found.

I’m not looking forward to a sequel. Let’s hope the backers -- the institutions and people who support American democracy -- turn off the money and shut Trump and the Art of the Steal down. The show’s over.

NY AG Sues Trump for “Massive Fraud”

(WED 9/21/22)

New York State Attorney General Letitia James (center, above) announced a $250-million-plus civil suit against ex-President Trump, his family and his company. The suit seeks to permanently bar Donald J. Trump, sons Don Jr. and Eric, and daughter Ivanka from doing business in the state, James announced in a press conference Wednesday.

The former president also would be barred for five years from entering any commercial real estate acquisition in the state and from applying for any loans from New York-registered financial institutions.

The suit alleges Trump falsely inflated his net worth by billions of dollars over the years. The investigation covered 2011-2021. Of her many examples of alleged over-value, one included the former president’s own apartment at Trump Tower Manhattan, which was listed at 30,000 square-feet, roughly three times its actual size. As a result, the likely value of $127 million was inflated to $317 million in 2012, still more than any apartment sold in Manhattan.

Mar-a-Lago revenue should have been valued at less than $25 million per year, and no higher than $75 million per year – Trump valued his Florida residence and private club at $739 million, she said. No word on the value of Trump’s golden escalator.

The suit also includes these remedies:

• An independent monitor to oversee compliance, financial reporting, valuations and disclosure to tax authorities for no less than five years.

•Generally accepted accounting principles (GAAP)-compliant audited statements, showing Trump’s net worth, for five years.

•Replacement of current trustees of Donald Trump’s revocable trust with independent trustees.

The suit also seeks to permanently bar former Trump Organization CFO Allen Weisselberg and controller Jeffrey McConney from serving in financial control of any New York corporation or similar entity in the state. James said former Trump fixer Michael Cohen’s testimony before Congress sparked her office’s investigation. Such alleged white-collar fraud is not “victimless” crime, she said.

“When the well-connected break the law it reduces resources to working people, to regular people, to small businesses and to taxpayers,” James remarked.

“Claiming you have money that you do not have is not the Art of the Deal. It is the art of the steal.”

Biden Speaks to UN – President Biden did not have to alter his speech much, before the 77^th meeting of the United Nations General Assembly in New York in light of Russian President Vladimir Putin’s bellicose statement about extending his attack on Ukraine.

“This war is about extinguishing Ukraine’s right to exist as a state,” Biden said, “plain and simple. And Ukraine’s right to exist as a people. Whoever you are, wherever you live, whatever you believe, that should make your blood run cold.”

Biden equated the fight for Ukraine’s sovereignty as a democratic nation with the struggle to maintain democracy everywhere, including the U.S.

“The only country standing in the way of that is Russia,” he said. While Biden was expected to alter his remarks after Putin announced his “partial military call up” CNN reports the president’s speech written before that announcement held up.

Extending the UN Permanent Security Council: Biden noted that 141 nations share the United States’ condemnation of Russia’s invasion of Ukraine. He called on the UN to expand its permanent Security Council, which since its inception consists of China, France, the Russian Federation (previously Soviet Union), the United Kingdom and the U.S. Currently, any single country among these five may veto a UN resolution.

Global food security: Biden also announced $2.9 billion in federal funding to strengthen global food security. He disputed Putin’s statement that current global food insecurity is the result of Western sanctions against Russia for its invasion of Ukraine.

“Our sanctions explicitly allow Russia the ability to export food and fertilizer,” Biden said.

Putin’s Not Bluffing? – Russian President Vladimir Putin announced a “partial military call-up” mobilizing up to 300,000 reservists – falling just short of a draft -- to hold its border with Ukraine, the AP and NPR report. This has set Russians “scrambling” to buy airline tickets out of their country. In his seven-minute address Wednesday, Putin “also warned the West he isn’t bluffing about using all the means at his proposal to protect Russia’s territory,” a veiled reference to the country’s nuclear capability.

But Russian nukes, as always, are held in-check by Western nations’ capabilities, Sergey Radchenko, professor of Russian history at Johns Hopkins School of Advanced International Studies, told NPR’s Morning Edition, so Putin’s claim his sabre-rattling is not a bluff hints it is indeed a bluff. And U.S. ambassador to Ukraine Bridget Brink tweeted that Russia is showing “weakness” and “failure” after its escalation of the war. She vowed that the U.S. will never recognize Russia’s scheme to claim Ukrainian territory.

Radchenko said plans announced Tuesday by eastern and southern regions of Ukraine currently controlled by Russia to hold votes on becoming an integral part of Russia – which Ukrainian President Vlodomyr Zelenskyy has called a “sham” – is a ploy for Putin to claim that it is Ukraine doing the invading when the country tries to take back those territories.

Biden’s UN Speech: Coming up Wednesday morning, President Biden speaks before the United Nations General Assembly (which Putin will not attend, despite Russia’s membership). The White House is scrambling to rewrite Biden’s speech in light of Putin’s announcement from Moscow, MSNBC’s Morning Joe reports.

No Cake in Mar-a-Lagogate – Special Master Raymond Dearie, the candidate of the two candidates named by Donald J. Trump’s attorneys who was agreed to by the Justice Department, “appeared skeptical” about the former president’s claim he “declassified” classified documents recovered in the FBI’s August 8 search of Mar-a-Lago, as Time put it Wednesday morning. On Tuesday, Judge Dearie told Trump’s attorneys “You can’t have your cake and eat it.”

Upshot: Trump’s attorneys have avoided arguing that Trump had declassified the documents for fear of breaching ethics standards with an untruth.

Mortgage Rates Hit 6% -- The Federal Reserve Open Market Committee is expected to raise interest rates by 75 basis points (0.75%), when it meets Tuesday and Wednesday, Punchbowl News reports. The Fed has been imposing big increases in the interest rate since inflation hit 40-year record highs, and Chairman Jerome Powell (pictured above) will likely signal more big increases until inflation comes down significantly from its current 8.3% annual rate. The mortgage rate is running at 6% for the first time since the inauspicious year 2008.

Note: Warnings of a coming recession among some economists (and most Republicans, looking to save their prospects in the midterms) are offset by other economists (and the Biden White House) who point to record-low unemployment and high job growth. The economic anomaly is that we’re still suffering the ravages of the COVID-19 pandemic (despite Biden’s claim on 60 Minutes that it’s over) as well as the effects of the cutoff of Russian oil to Europe, where Germany and the United Kingdom in particular, are suffering higher inflation rates and face almost certain recession and a cold winter.

This is not to downplay the economic suffering of the American working- and middle-classes, but if Vladimir Putin has had any personal success in his brutal attack on Ukraine, it’s that he has hijacked potential economic recovery in the West following shutdowns from the pandemic.

Texas Sheriff Investigates DeSantis’ Flights – Bexar County, Texas Sheriff Javier Salazar (D) has opened an investigation into Florida Gov. Ron DeSantis’ (R) political stunt he played out on Fox News in which 50 Venezuelan migrants were flown from San Antonio to Martha’s Vineyard in Massachusetts last week. The migrants had turned them in to U.S. Border Patrol after crossing from Mexico and were granted “temporary protected status,” and Salazar is looking into whether they were “lured from the Migrant Resource Center” under “false promises” for work and assistance, according to The Washington Post.

This Week in NYC and DC (MON 9/19/22)

The White House – Joe and Jill Biden attended Queen Elizabeth II’s funeral in London Monday as the United States had a chance to react to the president’s comments on CBS News’ 60 Minutes Sunday night that U.S. troops would defend Taiwan if China conducted an “unprecedented attack.”

“So unlike Ukraine, to be clear, sir, U.S. forces, U.S. men and women would defend Taiwan in the case of a Chinese invasion?” 60 Minutes’ Scott Pelley asked.

“Yes,” Biden replied.

Chinese spokesman Liu Pengyu said in a series of tweets that Biden’s remarks “sends wrong signals to Taiwan independence’ separatist forces, and severely jeopardizes China-U.S. relations and peace and stability across the Taiwan Strait,” CBS News reports.

Biden also told Pelley that he hasn’t decided whether to run for re-election in 2024, and said that he was not briefed about the top-secret documents found at Donald J. Trump’s Mar-a-Lago, nor was he aware of the FBI’s search warrant ahead of time.

This Week – The United Nations 77^th General Assembly begins Monday at its New York City headquarters, the first in-person meeting since 2019. President Biden is expected to give his speech Wednesday on the war in Ukraine and on climate change, a day later than the U.S. president’s usual place on the schedule, because of his attendance at Queen Elizabeth II’s funeral.

The House of Representatives and Senate are in-session Monday through Thursday; the Senate only is in session on Friday.

Judge Picks Dearie -- This all seems to have gone to Donald J. Trump’s plans, with a federal judge he appointed after losing the 2020 election refusing to allow the Justice Department to review documents seized from his Mar-a-Lago home August 8 until a special master requested – demanded – by the ex-president’s attorneys has examined them first. That special master appointed by Judge Aileen Cannon Thursday, senior New York Federal Judge Raymond Dearie, was proposed by Trump’s attorneys and deemed acceptable by the Justice Department.

The Justice Department is not allowed to use the sensitive documents in its investigation while Dearie reviews them and is expected to appeal Cannon’s ruling before the U.S. Court of Appeals for the 11^th District, in Atlanta, The Washington Post reports.

DOJ had argued that the special master should not be allowed to review the classified documents seized, but Cannon in her ruling said that it is a “matter of dispute” whether the documents marked classified are, in fact, classified. Trump’s attorneys have suggested that the documents may not be classified, but have not asserted that Trump personally declassified them, WaPo says. Trump also has not given any indication why he kept the papers.

Timing is key: Cannon has given Dearie to November 30 to complete his review, which pushes the case well into next year, when the GOP hopes to have majorities in both chambers of Congress and can begin some counter-investigations of its own. By then, too, Trump may very well have announced his bid for the 2024 Republican presidential nomination and will continue to accuse the DOJ under the Biden White House of conducting yet another “witch hunt.”

2020 Election tampering … CNN has obtained video surveillance tape showing Cathy Latham, already under investigation for signing a document as a fake elector in the 2020 presidential election, unlocking a door to Coffee County, Georgia voting machines to three Trump operatives who were working with attorney Sidney Powell, on January 7, 2021. One of the three Trump operatives is identified as an IT specialist.

The video from a Manchester, Georgia video office was recorded on the same date various elections offices in swing states were illegally breached, according to CNN.

Statement released: Attorney Bob Cheeley said in a statement, "Ms. Latham has not acted improperly or illegally ... Ms. Latham did not authorize or participate in any ballot scanning efforts, computer imaging or any similar activity." (Per CNN.)

Truss replaces Johnson … Queen Elizabeth made it official Tuesday at her Balmoral, Scotland, castle conferring on Liz Truss the U.K.’s 56^th prime ministership, per The Guardian, thus replacing the scandal-plagued Boris Johnson. Truss, 47, is the U.K.’s third female prime minister, after Margaret Thatcher and Theresa May, all of them Conservative Party leaders. Truss has so far indicated placing some distance between the U.K. and U.S., traditionally known as the closest of allies, over the disastrous withdrawal led by the U.S. from Afghanistan last year, NPR’s Morning Edition reports.

Economic challenges: Truss has promised to cut taxes for a nation reeling over the economic hits from the COVID-19 pandemic. The U.K.'s inflation rate is currently 10.1%, CNN notes, versus the 8.5% rate in the U.S.

Judge grants Trump special master … Federal District Judge Aileen M. Cannon in a court order issued Monday said she would appoint a special master to examine nearly 13,000 documents that the FBI seized from ex-President Trump’s Mar-a-Lago estate and private club on August 8. Cannon ordered both Trump’s attorneys and the Justice Department to each submit a list of acceptable candidates for the job by Friday.

The Justice Department is conducting a criminal investigation of Trump’s possession of the government documents, which include papers labeled “Secret” and “Top Secret.” Cannon ruled that the department must stop its review of the documents until after the special master concludes his or her assessment.

Upshot: Based solely on that number -- nearly 13,000 documents – DOJ’s criminal investigation, which appears to include potential obstruction of justice violations, will run well past the November 8 midterm elections and would give Trump plenty of time to announce a run for the 2024 GOP presidential nomination. Chalk this up as a win for Trump, who appointed Cannon to the Southern District of Florida court.

Reading Under the Redacted Lines

The 38-page redacted document* released last Friday to comply with a Southern District Court of Florida judge’s order to unseal the affidavit giving probable cause that crimes were committed at ex-President Trump’s Mar-a-Largo home seems complex. But the steps leading up to this legal search are simple to comprehend. It was prompted by 184 returned documents that Trump took from the White House including 25 marked “Top Secret” and 92 marked “Secret” that deal with, well, spying.

This is really a simple matter in my view, requiring only the simplest explanation of what is going on.

First, remember that Trump, aka FPOTUS [Former President Of The United States in the filing] publicly demanded that the affidavit justifying the search be released but then took no legal actions whatsoever to compel the court to do so. The crux of the matter is on page 31 subhead 78, “Subject Offenses” and 31 subhead 79 that probable cause exists to believe that evidence, contraband, fruits of crime or other items in violation of USC [United States Code]… will be found at the premises.” Premises, in this case, means multiple, unsecured places at the complex – all of them unsecured with relatively easy access to whomever was poking about.

Remember that classified documents were found previously, which goes back to when Trump left the White House and then later when the National Archives got some documents that should never have left the White House. The first contact with Trump on this matter was May 6, 2021. Government officials were trying to get the documents returned. So the search was hardly a surprise, let alone a misuse of power. Rather it was an attempt to recover loose documents containing state secrets.

As this unfolds Trump and others potentially face a trial in a U.S. Court of law, not Trump’s bully insurrectionist court of fraudulent opinion. There are some serious charges here ranging from the mishandling of classified documents, and/or possible violations of the Espionage Act and obstruction of justice statutes. [from heading 14 in the release “Foreign Intelligence Surveillance Act” (FISA) is a dissemination control designed to protect intelligence derived from the collection of information authorized under the Foreign Intelligence Surveillance Act, by the Foreign Intelligence Surveillance Court, or “FISC.”

Simply put: FPOTUS maliciously kept national security records that he was required to turn over to the National Archives. There is a DOJ ongoing investigation and a grand jury looking into violations of a series of grave National Security matters that are discussed under the redactions.

In time, I think some of these serious legal matters will become better known -- likely in only the vaguest of outlines given how sensitive and life-threatening they are to our National Interests and the people who look at for them -- in subsequent legal proceedings.

“1. The government is conducting a criminal investigation concerning the improper removal and storage of classified information in unauthorized spaces, as well as the unlawful concealment or removal of government records. The investigation began as a result of a referral the United States National Archives and Records Administration (NARA) sent to the United States Department of Justice (DOJ) on February 9, 2022, hereinafter, “NARA Referral.” The NARA Referral stated that on January 18, 2022, in accordance with the Presidential Records Act (PRA), NARA received from the office of former President DONALD J. TRUMP, hereinafter “FPOTUS,” via representatives, fifteen (15) boxes of records, hereinafter, the “FIFTEEN BOXES.” The FIFTEEN BOXES, which had been transported from the FPOTUS property at 1100 S Ocean Blvd, Palm Beach, FL 33480, hereinafter, the “PREMISES,” a residence and club known as “Mar-a-Lago,” further described in Attachment A, were reported by NARA to contain, among other things, highly classified documents intermingled with other records.

2. After an initial review of the NARA Referral, the Federal Bureau of Investigation (FBI) opened a criminal investigation to, among other things, determine how the documents with classification markings and records were removed from the White House (or any other authorized location(s) for the storage of classified materials) and came to be stored at the PREMISES; determine whether the storage location(s) at the PREMISES were authorized locations for the storage of classified information; determine whether any additional classified documents or records may have been stored in an unauthorized location at the PREMISES or another unknown location, and whether they remain at any such location; and identify any person(s) who may have removed or retained classified information without authorization and/or in an unauthorized space.

3. The FBI’s investigation has established that documents bearing classification markings, which appear to contain National Defense Information (NDI), were among the materials contained in the FIFTEEN BOXES and were stored at the PREMISES in an unauthorized location.
